Failure to renounce an inheritance will be considered its acceptance

Failure to renounce an inheritance will be conditionally considered acceptance of the inheritance. As reported by Oxu.Az, this is reflected in the proposed draft amendments to the Civil Code of the Republic of Azerbaijan.

According to the current legislation, the heir has the right to refuse to accept the inheritance within three months from the day when he learned or should have learned about the call to inheritance. If there are valid reasons, the court may extend this period by no more than two months.

According to the proposed amendment, the inheritance will be considered accepted by the heir if he does not refuse to accept the inheritance within the above-mentioned period.
