Court judgement in the case of doctors accused of negligence leading to the death of newborns

The Agdash District Court completed the hearing in the criminal case of Ziyafet Rustamova and Rakhil Khalilova, accused of negligence, oxu.az reports. At the meeting chaired by Judge Javid Sultanov, a verdict was read out, according to which Z. Rustamova was sentenced to imprisonment for 1 year and 6 months probation. Rakhila Khalilova was sentenced to 1 year in prison. The verdict stated that she must serve her sentence in a local correctional facility.

It is noted that on December 12, 2022, in the maternity ward of the Agdash central district hospital, Gulshan Bagiyeva gave birth to a stillborn child, and on December 25, the baby born to Afsana Hajiyeva died here. Based on these facts, criminal cases were initiated.

During the investigation, it was established that the death of the newborns occurred as a result of poor-quality medical services provided by obstetrician-gynecologist Ziyafet Rustamova and neonatologist Rakhila Khalilova.

Based on the collected evidence, the medical workers were charged under Article 314.2 (negligence resulting in the death of the victim or other grave consequences through negligence) of the Criminal Code of the Republic of Azerbaijan, and the criminal cases were sent for consideration to the district court.
