The director of the housing construction cooperative who faked his death sentenced

At the trial chaired by Judge Sabina Mammadzade of the Baku Court of Grave Crimes, the judgement was read out to the director of the housing construction cooperative (HCC) Rafet Ganiyev, accused of fraud, oxu.az reports. Thus, on the basis of the verdict, criminal prosecution under Article 313 (official forgery) of the Criminal Code of the Azerbaijan Republic was terminated due to the expiration of the statute of limitations for bringing the accused to criminal liability under the relevant article. As a result, the defendant was sentenced to eight years in prison. Prosecutor Ziya Mansurov petitioned to sentence R. Ganiyev to 11 years in prison.

It is noted that on November 25, 2021, the Sabirabad district prosecutor’s office received information about the discovery of human bones in a burnt car on the side of the road in the village of Buldug. During the preliminary investigation, it was established that the burnt car found on the Sabirabad-Garagyunei highway belonged to Rafet Ganiev (born 1980). Forensic medical and forensic genetic examinations were ordered to establish that the bones found in the car belonged to R. Ganiyev.

As a result, it turned out that R. Ganiyev did not die in an accident and, in order to avoid criminal liability for fraud in the sale of apartments in a building located in Baku and owned by the housing cooperative Caspian Inşaat MB, where he was the director, he faked his death, for which purpose he deliberately set fire to the car, placing animal bones in it.

As a result of operational activities carried out by employees of the prosecutor’s office and the police department of the Sabirabad district, his whereabouts were established, R. Ganiyev was detained while purchasing a TV using an identity card in one of the stores in the Yasamal district of the capital.

The investigative body charged Rafet Ganiyev under Article 178.2.3 (fraud committed on a large scale) of the Criminal Code of the Azerbaijan Republic.
